My preferred option would be to choose a hybrid approach. Give your tenant a 6-month rent. I recommend that you issue a section 21 notification, in addition to the rental agreement and the mandatory information required by the rental deposit system. Then, if the first 6 months have passed and the lease is going well, consider giving the tenant a longer lease if they wish. I can never stress enough that the long-time tenants in my experience generally make homeowners happy and satisfied. So it`s perfectly legal to go for a short let. However, the downside is that a less than 6-month-old can only use a section 21 after the expiry of a 6-month lease agreement to obtain accelerated possession. If the tenant stops paying the rent after month 2, it may still take 4 months to obtain the order of ownership of a rental property. If you are concerned about this exposure to risk, it is to make a large rental deposit to cover this period. Owners can go here to download their free lease.
On the one hand, many landlords assume that the minimum term of a lease under an insured short-term lease must be 6 months. Not like that. It is perfectly legal to rent your property for less than 6 months. In fact, there is no minimum period for an ASST. Until February 1997, the minimum was 6 months, but this requirement was removed by the Housing Act 1996. The average duration of a lease is 9 months. Therefore, it is useful for an owner to grant a slightly longer lease in many ways. One of my long-time tenants still likes a 9-month lease. The advantage for a homeowner is that it reduces paper work if it has to renew a fixed-term lease every 6 months. Most leases are automatically entered into with short-term leases. This is probably this type of lease if: The section 21 procedure for terminating a lease can be applied if a lessor does not need a specific reason to terminate it.
Sometimes it was called or called an evacuation without problems. Section 21 is normally used when an AST reaches the end of its lifespan and the lessor does not wish to extend it. It is also used to end a periodic rent – see later. Most homeowners enter a minimum of six months and then allow the lease to continue until either party wants to terminate it. As an owner, you are most likely busy with regular rental periods at some point. Periodic rent is usually common from month to month – or regardless of how often the rent is paid – instead of being for a fixed term. That`s why it`s important to use the right kind of legal agreement – one that gives you as much control as possible over your property. At the end of the limited period, the landlord can either grant the tenant a new temporary AST term (provided they want to) or continue the rent monthly. In this case, it becomes a periodic lease – see more information later.
